PROTECTION AND PROCESSING OF PERSONAL DATA OUR POLICY AND THE GENERAL CLARIFICATION TEXT
1. DATA CONTROLLER IDENTITYYour personal data will be processed by Şeynan Turizm Otelcilik Anonim Şirketi (trade name: Nearport Hotel, hereinafter referred to as “Nearport Hotel” or the “Company”) as the Data Controller in accordance with Law No. 6698 on Protection of Personal Data (“KVKK”), the EU General Data Protection Regulation (GDPR), and applicable legislation.
2. PURPOSE OF PERSONAL DATA PROCESSING AND PROTECTION POLICYNearport Hotel, as Data Controller, treats the security of your personal data with the utmost sensitivity. It is among our top priorities to process, record, transfer, share, and store all types of personal data of individuals associated with the Company—including guests—in compliance with KVKK. Protecting personal data is a core policy. Our Company pledges to fully comply with the legal obligations under these laws and processes data only within necessary scope, for required purposes, and in line with legal limits.
3. CATEGORIES OF PERSONAL DATA PROCESSEDIn accordance with KVKK and related legislation, we may collect and process the following data categories for specified legal and operational purposes:
Identity Information: Name-surname, place/date of birth, nationality, Turkish ID number, accompanying guest details (name, birth details)
Contact Information: Address, phone number, email
Financial Information: Bank account details, credit card data
Special Categories (only with explicit consent): Photo, health status and medication usage, smoking habits, allergen information
Other: Room number, vehicle license plate number
4. PURPOSES OF DATA PROCESSINGYour personal data may be processed for these main purposes, based on legal grounds in Articles 5 and 6 of KVKK:

Providing our products/services tailored to customers’ needs and preferences

5. DATA DISCLOSURE AND RECIPIENTSUnder KVKK Articles 8‑9, your data may be transferred, under strict legal compliance, to:
Public institutions and authorities
Third‑party service providers, business partners, consultants
No overseas transfers are made
Data is never shared for marketing to third parties without your explicit consent
6. COLLECTION METHODS & LEGAL BASISNearport Hotel may collect personal data via:
Verbal, written or electronic communications at our hotel or digital platforms
Third parties like travel agencies, tour-operators, job portals
CCTV footage, for security purposes
All collection is legally based on KVKK Articles 5‑9, according to the relationship and necessity.
7. YOUR RIGHTS (Under KVKK Article 11)You are entitled to:
Learn whether your personal data is processed
Request details if processed
Know the purpose and ensure lawful use
Learn domestic or international recipients
Request correction of incomplete or inaccurate data and notify recipients
Request deletion or anonymization when legal grounds cease, and notify recipients
Object to automated processing leading to adverse outcomes
Seek compensation if harm arises from unlawful processing
8. DATA RETENTIONPersonal data is stored only for necessary timeframes. When purposes lapse—or legal retention periods end—data is deleted, destroyed, or anonymized under KVKK and related regulations.
9. PROCESSING WITHOUT EXPLICIT CONSENTIn line with KVKK Article 5, Nearport Hotel may legally process your personal data without explicit consent when:
Consent cannot be obtained due to capacity or emergency (protecting life or bodily integrity)
Necessary for fulfilling a contract agreed with you
Required by law or legal obligation
Publicly disclosed by the data subject
Required for establishing or defending a legal right
Necessary for legitimate interests, not harming fundamental rights or interests
10. RETENTION PERIODSUnder KVKK Article 7/f‑1 and the Regulation on Deletion, Destruction, or Anonymization, your data will be deleted, destroyed, or anonymized when processing purposes end and/or statutory retention periods expire.
11. PROCESSING SPECIAL CATEGORY DATA“Special categories” under KVKK Article 6 include data relating to health, biometrics, criminal records, etc. Such data is processed only:
If you give explicit consent, enabling us to provide personalized services you request (e.g., medical-related requirements, allergen meals, room preferences)
Without consent, only as legally allowed—e.g., health data used for public health, medical diagnosis, treatment by authorized institutions
